Terms and Conditions of the Online Store fitoncydy.pl
(Full translation)


§1 General Provisions

1.1. These terms and conditions govern the rules for using the online store operated at www.fitoncydy.pl.

1.2. The online store operating at www.fitoncydy.pl (hereinafter referred to as: the FITONCYDY Online Store) is operated by Baltic Griffin Krzysztof Kurpiecki, ul. Skłodowskiej 29/35, 14-202 Iława, Poland, VAT ID PL7441343773.

1.3. Contact information for the company, enabling the Buyer to communicate with the Seller:

1.4. The terms and conditions of the FITONCYDY Online Store are continuously available on the website [website address] in a way that allows Clients to access, reproduce, and save their content. The terms and conditions are also provided to Clients before entering into a contract.


§2 Definitions

The terms used in these terms and conditions shall mean:

2.1. Consumer – a natural person as defined in Article 221 of the Civil Code.

2.2. Entrepreneur with consumer rights – a natural person entering into a contract directly related to their business activity, where the content of the contract indicates it does not have a professional character for them, based on the nature of their business activity, as made available under the regulations on the Central Registration and Information on Economic Activity.

2.3. Entrepreneur – a natural person, legal entity, or organizational unit without legal personality, granted legal capacity by law, conducting business or professional activity in their own name and undertaking legal actions directly related to their business or professional activity.

2.4. Service Provider/Seller – BALTIC GRIFFIN, NIP 7441343773.

2.5. Online Store – the online store operated at [store website address] by [entity name].

2.6. Civil Code – the Civil Code Act of April 23, 1964 (Dz.U.2020.1740).

2.7. Products and Services – all services provided and goods that are the subject of the sales agreement between the Seller and the Buyer.

2.8. Terms and Conditions – these terms and conditions for electronic service provision, as defined in Article 8 of the Act on Providing Services by Electronic Means of July 18, 2002 (Dz.U.2020.344).

2.9. Client/Buyer – a natural person, legal entity, or organizational unit without legal personality, granted legal capacity under special provisions, who places or intends to place an Order via the Online Store using electronic means, including Consumers, Entrepreneurs with consumer rights, and Entrepreneurs.

2.10. Order – the Client’s declaration of intent, in which they accept the Seller’s sales offer that includes, in particular, the price, type, and quantity of Products or Services under the sales agreement made via the Online Store.

2.11. Consumer Rights Act – the Act of May 30, 2014, on Consumer Rights (Dz.U.2020.287).


§3 Rules for Using the Online Store

3.1. Prices for all products and services offered by the Store are gross prices (including VAT) and are expressed in Polish zlotys (PLN). Exceptions to the use of Polish currency are explicitly marked.

3.2. Prices listed on the fitoncydy.pl website, as well as product and service descriptions, constitute only commercial information, not an offer as defined in the Civil Code. They become binding for concluding a specific agreement only upon the Seller’s confirmation of the order’s acceptance for execution.

3.3. The Seller uses discount codes in the fitoncydy.pl Online Store, which entitle the Client to purchase products at a discount indicated on the coupon. Discount codes cannot be exchanged for their cash equivalent.

3.4. Placing an order in the fitoncydy.pl Online Store requires acceptance of these Terms and Conditions.

3.5. To effectively place an order in the fitoncydy.pl Online Store, it is necessary to have a device with internet access that allows browsing websites and a keyboard or another device enabling the proper completion of electronic forms. It is recommended to use the latest versions of internet browsers: Firefox, Chrome, Internet Explorer, Microsoft Edge, Opera, Safari for OS X, etc.

3.6. The Store website utilizes Responsive Web Design (RWD) technology, which adapts website content to the device it is displayed on. The Store’s website is prepared for display on both desktop computers and mobile devices.

3.7. The fitoncydy.pl Online Store website has an SSL certificate – a secure communication encryption protocol.


§4 Terms of Concluding a Sales Agreement

4.1. Orders in the fitoncydy.pl Online Store can be placed by completing the appropriate forms available on the store’s website.

4.2. When placing an order, the Client is required to provide accurate personal data: full name, residential address, email address, and mobile phone number.

4.3. Upon receiving the order, the Seller confirms its receipt and simultaneously informs about the order’s acceptance for execution. Order confirmation is made by sending an appropriate email message to the Client’s address provided in the order form. Upon confirmation of order acceptance by the Seller, the agreement is deemed concluded.

4.4. The provision and preservation of the sales agreement content are carried out by making these Terms and Conditions available on the Online Store’s website and sending the appropriate information to the Client’s email address provided during the order process.

4.5. Orders in the fitoncydy.pl Online Store can be placed 24/7, every day of the year.


§5 Payment Methods and Payment Deadlines

5.1. Payments in the fitoncydy.pl Online Store can be made in one of the following ways:

  • Bank transfer to the Seller’s account,
  • Through external payment service providers.

5.2. After placing an order, the Client receives an email with the bank account number to which the appropriate amount should be transferred. Upon the payment being recorded in the store’s bank account, the order is processed.

5.4. The fitoncydy.pl Online Store may enable payments via the following external electronic payment services:

  • PayPro
  • Tpay.com
  • DotPay
  • PayU
  • PayPal
  • Przelewy24
  • PayNow

5.5. The Client must make payment using one of the above methods within 7 calendar days from the date of concluding the sales agreement.

5.6. If the option of payment on delivery is provided and selected, the Client is required to pay upon receipt of the shipment.


§6 Delivery

6.1. Ordered goods are delivered only within the territory of the Republic of Poland to the address specified by the Client in the order form.

6.2. The shipping time for goods is indicated on the Online Store’s website [store name] and is 48 hours. The Seller will make every effort to ensure the delivery occurs within the time specified on the product page in the store. If delivery within the specified time is not possible, the Buyer will be immediately notified.

6.3. Delivery of ordered goods is carried out through:

  • DHL Parcel
  • UPS
  • GLS
  • InPost Courier
  • DPD Courier
  • Paczka w RUCHu
  • Poczta Polska
  • GEIS
  • InPost Parcel Lockers.

6.4. Upon handing the goods over to the courier, the Buyer is notified via email sent to the address provided in the order.

6.5. The Client can also personally collect the ordered goods from the Baltic Griffin headquarters. In this case, the Buyer does not incur delivery costs.

6.6. The delivery costs, which the Client incurs in addition to the product price, are provided on the Store’s website during the ordering process.

6.7. The Client bears the full cost of delivery in the case of payment on delivery.

6.8. Upon receiving the goods, the Client is required to confirm their receipt. From that moment, the goods become the Client's property.

§7 Withdrawal from the Agreement

7.1. A Buyer who is a Consumer or an Entrepreneur with consumer rights, who has entered into a distance or off-premises agreement, has the right to withdraw from the concluded sales agreement within 14 days from the date of receiving the goods, without providing any reason.

7.2. In the event of exercising the right mentioned in the preceding point, the Buyer should inform the Seller by submitting a withdrawal statement on a form provided by the Seller, which can be sent by post to the address: [Store address for withdrawal] or electronically via an electronic withdrawal form sent to the Seller’s email address [email address]. To meet the deadline, it is sufficient to send the statement before it expires. A withdrawal statement submitted after the deadline specified in §7 point 7.1 has no legal effect.

7.3. A withdrawal form template (Appendix No. 1 to these Terms and Conditions) is provided to the Buyer in paper form (in the documentation included with the shipment) and electronically (as an attachment to the email confirming the order acceptance).

7.4. If the Consumer or Entrepreneur with consumer rights submits a withdrawal statement electronically via the electronic withdrawal form, the Seller will promptly confirm receipt of the withdrawal statement (on a durable medium as defined in Article 2 point 4 of the Act of May 30, 2014, on Consumer Rights).

7.5. The cost of returning the goods, except in cases specified in Article 33 (i.e., additional costs resulting from the Consumer’s or Entrepreneur’s choice of a delivery method other than the least expensive standard delivery method available in the Online Store) and Article 34(2) of the Act of May 30, 2014, on Consumer Rights, is borne by the Seller.

7.6. The Buyer is obligated to adequately secure the returned goods to prevent damage during transportation. The Consumer or Entrepreneur with consumer rights bears the direct cost of returning the goods, as specified in Article 34(2) of the Act of May 30, 2014, on Consumer Rights (Dz.U. 2017, item 683).

7.7. The Consumer or Entrepreneur with consumer rights is required to return the goods without delay, no later than 14 days from the date on which they withdrew from the agreement. The Seller may stipulate that, in the event of withdrawal from the agreement, the goods to be returned will be collected by the Seller or an authorized person.

7.8. If the delivered goods are incomplete or show signs of use beyond normal management of the item, the Seller reserves the right to refuse acceptance of the returned goods or to reduce the refunded amount by the equivalent value of the damaged goods.

7.9. In the event of withdrawal from the agreement, all payments made by the Buyer, including delivery costs, will be refunded to the Buyer’s bank account promptly, but no later than 14 days from the date the Seller receives the Buyer’s withdrawal statement.

7.10. The Seller declares that the refund mentioned in §7 point 7.9 will be made using the same payment method the Buyer used. The Seller, in agreement with the Buyer, may establish a different refund method that does not involve additional costs for the Buyer.

7.11. The Seller declares that the right to withdraw does not apply to agreements listed in Article 38 of the Act of May 30, 2014, on Consumer Rights.

7.12. By entering into an agreement, the Consumer or Entrepreneur with consumer rights confirms that they have read and understood these terms and conditions, including confirmation of being informed about the right to withdraw from the sales agreement within 14 days from the date of receiving the goods.


§8 Complaints

8.1. A User Complaint may be submitted via email to: sklep@fitoncydy.pl. The complainant may also submit a written complaint by postal mail to the following address: Baltic Griffin Krzysztof Kurpiecki, ul. Skłodowskiej 29/35, 14-202 Iława, Poland.

8.2. Baltic Griffin commits to processing complaints within no more than 15 business days. The review period may be extended if additional information is required, but it will not exceed 35 business days from the date the complaint is received.

§9 Rules for Publishing Reviews

9.1. Every Buyer/Client may publish reviews of a product/service in the appropriate section of the Store's website. The review should be written in Polish and adhere to the rules of correct Polish grammar.

9.2. Reviews are subjective statements by Clients. The Seller assumes no responsibility for their content.

9.3. The Buyer/Client declares that their statements do not violate applicable laws or third-party rights. They assume full responsibility for the content they post in the Online Store fitoncydy.pl.

9.4. Submitted reviews are verified by the Seller to ensure that they do not contain prohibited content, such as violations of applicable laws, offensive content, advertising, personal data, copyright violations, etc.


§10 Personal Data

10.1. The Seller is the administrator of personal data.

10.2. Rules for personal data protection are outlined in the Privacy Policy of the fitoncydy.pl Online Store, available on the website [website address].


§11 Final Provisions

11.1. The Seller reserves the right to amend these Terms and Conditions for important reasons. Any changes to the Terms and Conditions take effect within the timeframe specified by the Seller, but not shorter than 7 days.

11.2. The amended Terms and Conditions bind the Buyer/Client if the requirements of Articles 384 and 384[1] of the Civil Code are met, i.e., the Buyer has been properly notified of the changes and has not terminated the agreement within 14 calendar days of being notified.

11.3. In accordance with Article 8(3)(2)(b) of the Act of July 18, 2002, on Providing Services by Electronic Means, users of the Online Store are prohibited from posting unlawful content on the Store’s website.

11.4. Matters not regulated in these Terms and Conditions shall be governed by the relevant provisions of the Civil Code and the Act of May 30, 2014, on Consumer Rights.

11.5. These Terms and Conditions are available at [website address].

11.6. Agreements with the Seller are concluded in Polish.

11.7. These Terms and Conditions come into force on February 13, 2024.
